By accessing or using SalesAI, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

2. Description of Service

SalesAI provides an AI-powered sales representative platform that automates outbound and inbound phone calls, including conversation handling, intent classification, sentiment analysis, and call recording. We reserve the right to modify, suspend, or discontinue any part of the service at any time.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use SalesAI. You represent that you have the legal authority to enter into these terms on behalf of your organization.

4. Account Responsibilities

Maintain the confidentiality of your account credentials
Notify us immediately of any unauthorized use of your account
Ensure all phone lists and contact data you upload comply with applicable laws
Obtain and maintain all required consents for outbound calling
Comply with all applicable telemarketing and telecommunications regulations

5. Acceptable Use

You may NOT use SalesAI to make unsolicited calls, contact individuals who have requested no contact, or engage in any fraudulent, deceptive, or illegal activities. See our Acceptable Use Policy for full details.

6. Payment Terms

Payments are processed through Creem, our Merchant of Record. By subscribing, you agree to pay all fees associated with your chosen plan. Subscriptions auto-renew unless canceled before the renewal date. All fees are non-refundable except as described in our Refund Policy.

7. Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation, your plan remains active until the end of the current billing period. We may terminate accounts that violate our Acceptable Use Policy.

8. Call Recordings & Data

Call recordings are stored for 90 days. You retain ownership of your call data and customer contact lists. We process this data to provide the service and may use anonymized, aggregated data for service improvement.

9. Limitation of Liability

SalesAI is provided "as is" without warranty of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

10. Indemnification

You agree to indemnify and hold harmless SalesAI and its affiliates from any claims, damages, or expenses arising from your violation of these Terms, your use of the service, or your violation of any applicable law.

11. Changes to Terms

We may modify these terms at any time. Material changes will be communicated by email. Continued use after changes constitutes acceptance of the modified terms.

12. Governing Law

These Terms are governed by applicable law. Disputes shall be resolved through binding arbitration or in the courts of the jurisdiction where SalesAI is established.
