1. Overview
SalesAI is committed to ensuring all outbound calling activities conducted through our platform comply with applicable telecommunications regulations worldwide. This page outlines the compliance requirements and best practices for using SalesAI's outbound calling features.
2. Regulatory Framework
Depending on your jurisdiction, the following regulations may apply to your outbound calling activities:
- United States: TCPA (Telephone Consumer Protection Act), FCC regulations, state-specific do-not-call laws, and the 2024 INET Act provisions
- European Union: GDPR, ePrivacy Directive, and national implementations
- United Kingdom: PECR (Privacy and Electronic Communications Regulations)
- Canada: CRTC regulations, CASL (Canadian Anti-Spam Law)
- China: Provisions on the Administration of Telephone Services and related regulations
- Other Jurisdictions: Local telecommunications and data protection laws
3. China's MIIT Regulation 74
For users operating in or targeting China, SalesAI complies with the Ministry of Industry and Information Technology (MIIT) Regulation No. 74 on Phone Number Conservation, which includes:
- Strict consent requirements before initiating outbound calls
- Restrictions on call frequency and timing (no calls during prohibited hours)
- Caller ID verification and number display requirements
- Recording and reporting obligations for call campaigns
- Data localization and cross-border data transfer restrictions
Users are solely responsible for obtaining all required licenses and approvals for outbound calling activities in China.
4. Consent Requirements
Before initiating any outbound call campaign, you must:
- Obtain prior express written consent from each called party (where required by law)
- Maintain records of consent for a minimum of 5 years
- Ensure consent was obtained in compliance with applicable law at the time it was given
- Verify that phone numbers are not on do-not-call registries
- Honor opt-out requests within 30 days
5. Do-Not-Call Registry Compliance
SalesAI provides tools to help you comply with do-not-call regulations:
- Built-in scrubbing against national DNC registries
- Automatic suppression of opted-out contacts
- Campaign-level DNC compliance checks before dialing
- Audit logs for compliance verification
You remain solely responsible for maintaining compliance with do-not-call requirements in your jurisdiction.
6. Caller ID and Number Display
All outbound calls must display accurate caller identification information. You must:
- Use only phone numbers you are authorized to use as caller IDs
- Ensure caller ID information is not falsified or spoofed
- Comply with STIR/SHAKEN authentication requirements (US)
- Use numbers from approved sources with proper documentation
7. Call Recording Compliance
When recording calls, you must:
- Comply with applicable two-party/all-party consent laws
- Notify all parties that the call is being recorded at the beginning of the call
- Obtain necessary consents before recording
- Store recordings securely for the required retention period (90 days for SalesAI)
8. Call Timing Restrictions
Outbound calls must only be placed during permissible hours. SalesAI enforces the following default restrictions:
- General: 8:00 AM - 9:00 PM local time of the called party
- China: 9:00 AM - 8:00 PM Beijing time, with no calls on national holidays
- EU/UK: 9:00 AM - 8:00 PM local time, no Sunday calls
These restrictions can be customized per campaign but cannot be removed entirely.
9. Call Content Requirements
All call content must comply with applicable law. Prohibited content includes:
- Misleading or deceptive statements
- False or unsubstantiated claims about products or services
- High-pressure tactics that constitute harassment
- Unsolicited offers for illegal products or services
10. Data Protection and Cross-Border Transfers
When processing personal data for outbound calling:
- Comply with applicable data protection laws (GDPR, CCPA, PIPL, etc.)
- For China-bound data transfers, ensure compliance with PIPL and data localization requirements
- Implement appropriate safeguards for cross-border data transfers
- Maintain data minimization principles — collect only what is necessary
11. Your Responsibilities
You are solely responsible for:
- Ensuring your calling campaigns comply with all applicable laws in your target jurisdictions
- Obtaining all necessary consents, licenses, and approvals
- Maintaining accurate records of compliance activities
- Responding to regulatory inquiries and enforcement actions
- Indemnifying SalesAI against claims arising from your non-compliant calling activities
12. Reporting Violations
If you become aware of a potential compliance violation, you must immediately:
- Cease the affected calling campaign
- Notify SalesAI support at support@salesai.com
- Preserve all relevant records and evidence
- Cooperate with any investigation
